If you do not agree with these Terms, you may not access or use our website or services.

2. Online Store & Platform

Our store is hosted by Shopify Inc., which provides the e-commerce platform that enables us to offer products and services for sale.

Shopify provides the technical infrastructure for the Store but is not a party to any sales contract between you and Linivaro.

All purchases made through the Store are made directly with Linivaro P.S.A.

By using the Store, you acknowledge that Shopify is not responsible for any aspect of your purchase, including product quality, delivery, refunds, or customer support. Any claims relating to products purchased through the Store must be directed to Linivaro.

3. Eligibility

By placing an order, you confirm that:

You are at least 18 years old, or
You have the consent of a parent or legal guardian,

and that you are legally capable of entering into a binding contract under applicable law.

4. Products & Made-to-Order Items

Many of our products are manufactured after an order is placed.

Product images are provided for illustrative purposes. Colors, print placement, scale, and final appearance may vary slightly due to screen settings, manufacturing processes, and material characteristics.

Minor variations that do not affect the intended use or quality of the product are not considered defects.

5. Prices & Taxes

European Union

For customers within the European Union, prices are displayed inclusive of VAT where applicable and required by law.

Outside the European Union

For customers outside the European Union, prices are generally displayed exclusive of VAT.

Import duties, customs fees, local taxes, and other charges imposed by the destination country are the responsibility of the customer.

Currency Conversion

Where multiple currencies are available, conversions are performed automatically by our e-commerce platform and payment providers.

Exchange rates may fluctuate and final charged amounts may vary slightly from displayed estimates.

Final prices are confirmed at checkout.

Price Changes

We reserve the right to modify prices at any time.

Price changes do not affect orders that have already been placed and paid for.

6. Orders & Payment

A sales contract is formed when:

Payment has been successfully processed, and
An order confirmation has been sent to you.

Payments are processed securely through Shopify Payments and other supported payment providers.

We do not store payment card information.

7. Right of Withdrawal & Consumer Rights

Customers may have statutory consumer rights, including rights relating to cancellation, withdrawal, returns, refunds, repairs, or replacements, depending on their country of residence and applicable law.

Where such rights apply, nothing in these Terms is intended to limit or exclude them.

Certain products, including personalized or custom-made items, may be exempt from statutory withdrawal rights where permitted by applicable law.

8. Returns, Refunds & Replacements

Our Refund Policy forms an integral part of these Terms.

Eligible products may be returned in accordance with the conditions and timeframes described in our Refund Policy.

Products that arrive damaged, defective, or incorrectly fulfilled may qualify for replacement, refund, or another appropriate remedy.

9. Shipping & Delivery

Shipping times are estimates only and are not guaranteed.

We are not responsible for delays caused by:

Shipping carriers,
Customs procedures,
Force majeure events,
Weather conditions,
Incorrect customer information,
Other circumstances beyond our reasonable control.

10. Incorrect Address & Undeliverable Orders

Customers are responsible for providing complete and accurate delivery information.

If an order cannot be delivered because of incorrect or incomplete address details supplied by the customer, additional shipping charges may apply for reshipment.

Refund eligibility for returned or undeliverable shipments may be reduced by any shipping, handling, or return costs incurred.

11. Intellectual Property

All content available through the Store, including designs, graphics, artwork, logos, photographs, text, product descriptions, and other materials, is the property of Linivaro P.S.A. or its licensors and is protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed, modified, or used without prior written permission.

Shopify and related trademarks remain the property of Shopify Inc.

12. Prohibited Uses

You may not use the Store or its content:

For unlawful purposes;
To violate any laws or regulations;
To infringe intellectual property rights;
To transmit malicious software or harmful code;

We reserve the right to restrict or terminate access where misuse occurs.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Linivaro shall not be liable for:

Indirect, incidental, special, or consequential damages;
Loss of profits, revenue, business opportunities, or data.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable consumer protection law.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Poland.

Any disputes shall be subject to the jurisdiction of the competent courts of Poland, without prejudice to any mandatory consumer rights or protections available under applicable law.
